To enhance your experience with our Websites and Services, we may collect various types of information:

  1. Information You Provide: We collect details you give us, including:
    • Account Information: If you create a User Account on our Websites or Services, you may provide personal details like your full name, email address, home address, phone number, postal code, gender, a profile bio, and date of birth. Some users may also share (i) age verification methods (e.g., driver‘s license) or (ii) medical marijuana recommendations, including the recommending doctor‘s name, license number, contact information, verification methods, and verification number (“Medical Marijuana Information”).
    • Public Content: Any content you contribute or post on our Websites or Services (“Public Content”) is intended for public viewing, including reviews, tips, photos, videos, check-ins, comments, likes, favorites, posts, events, bookmarks, friends, lists, compliments, and your User Account name and profile picture.
    • Transactional Information - Orders: If you make a purchase through our Websites or Services from a participating vendor (“Retailer”), you may provide us with personal details like your name, date of birth, phone number, delivery address, email address, and identification cards. Some users might also include Medical Marijuana Information when placing orders. This could encompass order history, as well as photos or signatures needed to process your order. If you order directly from Blunt Freak LLC, such as via store.bluntfreak.com, you may also share billing and shipping addresses.
    • Transactional Information - Other Requests: Occasionally, we might offer promotional campaigns or request your input in surveys or advocacy initiatives, requiring you to submit personal information like your full name, phone number, mailing address, email address, and professional details.
    • Employee/Agent Information: If you are an employee or agent of a Retailer, you may provide personal details like your name, vehicle information (including transportation method, make, model, color, and license plate number).
  2. Information Generated While Using Our Websites and Services
    • Transactional Information: When you initiate a transaction on our Websites or Services, we automatically gather certain details alongside the information you provide. This includes the date and time the transaction was started and any changes to its status.
    • Location Information: With your consent, we collect information about your specific or approximate geographic location. This can occur when you click a “Locate Me” button or when you act as a driver for a Retailer. If you have enabled location services on your mobile device, we can gather this data from there. Certain Services, like our Driver app, require access to your location and driving behavior to function properly. Additionally, we may determine your approximate location or IP address from your browser using cookies or other web technologies.
    • Other Browsing and Device Information: We automatically collect various information when you use our Websites and Services. This includes log data and device details, such as browser type, referring website, pages visited, access times, device ID, and your activities on our Websites or Services (e.g., links clicked, searches performed, duration spent on specific pages, and communications made through our platforms). We utilize cookies and other web technologies to assist in this data collection—more information can be found in our Cookies and Other Web Technologies section.
    • Communications: You may occasionally reach out to Blunt Freak LLC‘s customer support or communicate with other users, Retailers, or brands featured on our Websites. Messages exchanged through our Services are recorded. If you engage in SMS communication through our Websites, we log the phone numbers, carriers, and timestamps of these messages. We may also retain information provided during any communication with us, including phone calls, letters, emails, and in-person interactions.
  3. Information Collected from Other Sources
    • Retailers: Retailers may share information about you with us, either directly or through their service providers. For instance, during the order fulfillment process via our Websites or Services, Retailers might gather additional personal details from you and pass this information on to Blunt Freak LLC. They may use a point-of-sale service provider to manage transactions, track inventory, and ensure compliance with applicable laws. Retailers can instruct their point-of-sale providers to share your personal information with us, allowing us to maintain accurate records and facilitate your order efficiently. Additionally, Retailers may utilize loyalty program service providers to reward you for your purchases and share relevant information about these programs with us to enable you to redeem rewards on our platforms.
    • Third-Party Service Providers: Certain third-party service providers may collect information directly from you and share it with us. For example, if you order Blunt Freak LLC merchandise using a credit card, Shopify will provide us with relevant payment information, such as the credit card type and the cardholder‘s name. Other providers may gather information through cookies and similar web technologies, which they then share with us. More details on what third parties collect via these methods can be found in our Cookies and Other Web Technologies section.
    • Other Third-Party Sources: If you sign up for a User Account using a third-party login service (like Facebook, Google, or Apple), that service will provide us with personal details, such as your name and email address, to set up your account. Additionally, third parties utilizing our Services—whether paid or free—may allow us to collect data regarding your interactions with their websites or share that data with us. For example, if you use a Blunt Freak LLC embedded tool or widget on another website, we may receive information about your usage of that tool. We might also obtain data about you from various third-party sources and merge it with the information we already have. If you’re a Canadian user, you might be able to use a third-party payment processor to pay a retailer listed on our Website, in which case the processor could provide us with payment-related details, such as the type of card used, the cardholder‘s name, the last four digits of the card, and the postal code associated with it.

If you have legal rights to limit sharing, such as opting out of personalized marketing, you can exercise those rights as outlined in our relevant sections.
    • Business Transactions: If Blunt Freak LLC is involved in a merger, acquisition, or any business transfer, your information may be included as part of that transaction. In cases of insolvency or bankruptcy, your data could also be treated as a business asset.
    • Framing Technologies: Some Websites may use framing techniques to present content from third-party providers. For example, when you place an order on our site, your payment information is shared with Shopify, which manages the transaction according to their Privacy Policy.
    • Third-Party Logins: If you log in using a third-party service like Facebook or Google, both we and the third party may receive and share information about you. It’s a good idea to review the privacy policies of these services for further details.

    • Legal Compliance: We may disclose your information to government officials or law enforcement if we believe it’s necessary to comply with legal processes, investigate wrongdoing, or protect our rights or those of others.
    • Retailer Information Sharing: We may share certain user information (like age and gender) with Retailers when you place orders through our services. Retailers may also access your Public Content and order-related information.
    • Employee or Agent Data: If you work for a Retailer, we may collect and share your information, such as geolocation data, in our capacity as a service provider.
    • Communication with Retailers: If you contact a Retailer through our Services, we may share basic information about your contact (like date and time) with that Retailer. You can manage settings on your device to limit sharing of your contact details.
  8. Cookies and Other Web Technologies
  9. We may utilize cookies, web beacons, tags, scripts, and other technologies like local shared objects (e.g., HTML5) and advertising identifiers (such as Apple’s IDFA or Google’s Advertising ID) in connection with your use of our Websites or Services. Additionally, we may permit third parties to integrate their SDKs, cookies, or similar technologies into our Websites and Services to provide services on our behalf, including analytics and advertising. For further details on how we use cookies and other web technologies, please refer to our Cookie Notice.

  10. Managing and Deleting Your Information
  11. Your Right to Access and Manage Your Information

You have the right to access, review, correct, or update the information you provide when creating a User Account on our Websites or Services. To exercise this right, you can update your User Account directly, visit the Privacy Settings page, or submit a data request as outlined in our Data Requests section. It’s important to maintain accurate personal information in your User Account to ensure we can provide the best services to you. You may also disable certain location data through your device or browser settings. For instance, turning off “Location Services” for our application on iOS. However, please note that disabling location tracking may affect your experience and could be necessary for certain transactions.

Your Right to Delete Your Information

You have the right to delete specific personal information associated with your User Account or that you submit through our Websites or Services. However, keep in mind that some information may be necessary for account management, and deleting it could limit your ability to access certain features. If you wish to delete information, you can submit a data request as mentioned in our Data Requests section. We will not discriminate against you for exercising these rights. In some cases, we may retain information for legitimate business or legal reasons, or as required under this Privacy Policy. This could include retaining information to prevent or investigate wrongdoing or to comply with legal obligations. Some data may also be retained in backup files for internal administration and disaster recovery. We strive to minimize the duration for which we hold your information and will take reasonable steps to delete it when appropriate. Please note that you cannot delete information related to past orders and purchases, as we and third-party businesses may be required to keep these records for a specified duration under Michigan law. Additionally, public posts or communications you’ve made on our Websites or Services may not be removable, so please consider the information you share in those forums.

    Customer Data

Third-party businesses, like Retailers, may submit data about their customers to us (“Customer Data”) for various purposes, including hosting and processing. This data may include personal information such as names, locations, and email addresses. Any use of Customer Data by Blunt Freak LLC will comply with our Terms of Use and this Privacy Policy, or as required by law. If your personal information has been submitted to us as Customer Data by a third party and you wish to access, correct, or delete it, please contact that third-party business and also submit a data request as per our Data Requests section. We prioritize your privacy and take steps to protect your personal information, ensuring adequate data protection in line with international standards. If you have concerns regarding how we store or process your data, please reach out to us using the contact details provided below.

    Data Requests

If you wish to access, correct, or delete any personal information, please submit a written data request as outlined in our Contact Information section. We will take steps to verify your identity before processing your request. For instance, we might ask you to provide a piece of information we have on file that you should know. We cannot disclose personal information in response to a data request to anyone other than the individual concerned. Once any issues regarding the information requested are resolved, we will send you copies of the information electronically whenever possible, or by mail if necessary. If you submit multiple data requests that are excessive or unfounded, we may charge a fee of $20.00 to cover the administrative costs involved. In extreme cases, we reserve the right to refuse to fulfill such requests. We aim to respond to valid and verified data requests within the timeframe required by Michigan law. If you are dissatisfied with how your data request was managed, you can escalate your concerns to the appropriate data protection authority in your jurisdiction.

Your Right to Cancel or Modify Marketing Communications

You have the right to unsubscribe from or modify the email marketing communications you receive from us. You can do this by following the instructions in our promotional emails or by adjusting your communication preferences in your User Account. However, note that this won’t affect other subscriptions—if you opt out of certain emails, those preferences will be limited. While you can manage some email preferences, certain administrative, transactional, or legal messages from Blunt Freak LLC may still be sent to you if you have a User Account. However, you can request to close your User Account to stop receiving these announcements. You can also adjust your personalized advertising settings on third-party websites through the Privacy Settings page. When we show advertisements on other sites, we may use your information to present more relevant ads based on your activity on our platform. If you opt out of personalized advertising, you may still see our ads elsewhere, but they may not be as relevant to you.

  12. Your Michigan Rights; Privacy Notice for Michigan Residents
  13. This Michigan Privacy Notice (“MI Privacy Notice”) supplements the information in our Privacy Policy and applies specifically to visitors, purchasers, users, and others who reside in the State of Michigan (“Michigan Residents” or “you”) and who use our Services, as described in the Privacy Policy. In the event of any conflict between this MI Privacy Notice and the Privacy Policy, the MI Privacy Notice will prevail only to the extent necessary to resolve such conflict.

Information We Collect About Our Michigan Residents

The personal information covered under this MI Privacy Notice does not include aggregated data or other information that cannot reasonably be linked to you. In the past twelve months, regardless of whether you have a User Account or were logged in to any such account, we may have collected the following categories of personal information as outlined by Michigan privacy laws.

Your Rights as a Michigan Resident

As a Michigan Resident, you have certain rights regarding your personal information. You have the right to request the following information from us: (1) the specific pieces of personal information we have collected about you; (2) the categories of personal information we have collected; (3) the categories of sources from which your personal information was collected; (4) the categories of personal information we have sold or disclosed for a business purpose; (5) the categories of third parties to whom your personal information was sold or disclosed for a business purpose; and (6) the business or commercial purpose for collecting or selling your personal information. You also have the right to correct your personal information or request the deletion of any personal information we have collected and retained from you, subject to certain exceptions. Once we receive and confirm your verifiable request, we will delete (and instruct our service providers to delete) your personal information from our records, unless an exception applies. If we use information defined as sensitive personal information, we limit our use to what is necessary for providing our Websites and Services.

How to Exercise Your Rights Under Michigan Law

To exercise any of the rights described above, please submit a verifiable request by contacting us as outlined in our Contact Information section below. We must verify the identity of the requestor. You may designate an authorized agent to make a request on your behalf by providing proof of a valid power of attorney, your valid government-issued identification, and the authorized agent’s valid government-issued identification. Upon receiving your request, we will follow up with an email asking you to provide and certify information necessary to verify your identity. We cannot respond to requests where the identity and authority of the requestor cannot be confirmed. You are not required to have a User Account with us to submit a request, and we will only use personal information provided in a request to verify the requestor’s identity or authority. Please note that you may make a verifiable request for access or data portability twice within a 12-month period. Any disclosures we provide will cover only the 12-month period preceding the receipt of the verifiable request. If we are unable to comply with a request, we will inform you of the reason why.

    Personal Information Sold or Shared

We do not “sell” personal information in the traditional sense, and we will not do so without giving you the opportunity to opt out. However, Michigan law broadly defines “sale” to include sharing personal information for the purpose of targeted advertising or cross-context behavioral advertising. Like many online publishers, we use such information to provide our Websites and Services, offer personalized features, perform tracking and analytics, and display relevant offers to you. To opt out of targeted advertising, you can visit the Privacy Settings page and deselect “Personalized advertising.”

    Non-Discrimination Policy

Michigan Residents who choose to exercise the rights described in this section will not be denied goods or services, charged different prices or rates, or provided a different level or quality of goods or services, unless those differences relate to your personal information.

    Michigan Disclosure

Michigan law allows you to request a list of third parties to whom we have disclosed your personal information for their direct marketing purposes in the prior calendar year, as well as the types of personal information disclosed. We do not share personal information with third parties for their own direct marketing purposes without your prior consent. You can also prevent the disclosure of your personal information to third parties for their direct marketing purposes by withholding consent.

You can also take steps to protect your information, such as choosing a strong password for your device and User Account that is not easily guessed, and keeping your login credentials private. Blunt Freak LLC. is not responsible for the actions of unauthorized third parties who compromise our security measures, and we cannot be held liable for any unauthorized access, acquisition, or distribution of your personal information. If you suspect that your personal information has been compromised, we encourage you to notify us immediately as outlined in our Contact Information section below. We retain some personal information about you in accordance with our record retention policies, as required by law, or as necessary to fulfill the purposes outlined in this Privacy Policy (e.g., to enforce agreements or provide services).
